The Chamber described the recently imposed additional $100,000 fee on new H-1B applications as an “illegal and anti-entrepreneurial move.” The petition was filed on Thursday in the District Court of Columbia, directly challenging the presidential order issued on September 19.
The petition argues that the new fee policy violates the Immigration and Nationality Act and creates obstacles in the H-1B program, which falls under Congressional regulations. The Chamber warned that such increased costs would hurt startups, small, and medium-sized businesses that typically hire foreign experts.
The case has also named the Department of Homeland Security, the State Department, and senior officials like Kristi L. Noem and Marco Rubio as respondents. Meanwhile, as the U.S. tightens its visa program, China has announced a new work permit scheme under the K-Visa program, allowing foreign experts to work in China.
